He will also be registered in the national sex offender registry by the federal government. Everyone is allowed access to this information in the interest of public safety. Bail and Bondsman

If you are charged with a crime in Shelby County, you do not have to stay in jail while you wait for trial. The court may permit you to remain free in the interim as long as you pledge to return to court when the trial starts. For certain offenses, the court may also require another pledge – money or property. If you fail to appear in court as promised, the money or property you lodged with the court will be forfeited.

An individual who is unable to secure his release because of financial constraints can use the services of a bondsman. A bondsman is an individual who acts as a surety – claiming ownership of the defendant’s “debt” to the court if he does not appear as promised. In exchange for his promise to the court, the bondsman will charge a non-refundable fee equal to 10% of the bond amount.

The state of Kentucky has outlawed the business of running commercial bail bonds. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). The law requires a bondsman to obtain a warrant before he can arrest a fugitive hiding out in Kentucky. Ky. Rev. Stat. § 440.270.
