Bail and Bondsman
The court permits the temporary release of an accused person from custody or jail while awaiting trial as long as the accused gives assurance that he/she will be present during his court dates. The assurance can come in the form of a signed bond or, in some cases, it may include the pledging of money or property to the court. This process is called bail. In Kentucky, it is illegal to run a commercial bail bonds business. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). A bail jumper who has fled to Kentucky cannot be arrested by a bondsman from out of state without a warrant. Ky. Rev. Stat. § 440.270.
