Bail and Bondsman
If you are charged with a crime in Mason County, you can secure your temporary release from jail if you post bail. There are different types of bail. One type of bail will allow you to get out of jail with the understanding that you must show up at all your court dates. Other types of bail require you to lodge money or property to the court along with your promise to appear before the court at your trial. If you fail to do this, you will lose the money or property.
If you can’t come up with the bail money on your own, you can get the help of a bondsman. For a non-refundable fee, he will post bail for you. If you do not appear before the court as promised, it will be the bondsman who will be responsible for paying the entire amount. The fee is usually 10% of the bail amount.
Commercial bail bonding is banned in the state of Kentucky. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). An out-of-state bondsman can only apprehend a fugitive who has run away to Kentucky if he has a warrant.mea Rev. Stat. § 440.270.
