Bail and Bondsman

The court can permit the temporary release of an accused with the condition that money is put down to serve as a guarantee that he will appear at his trial. This permission is called bail. In Bell County, the bond (or bail) is set by the Circuit-District-Family Court Judges or Trial Commissioner. In some cases, an accused may not be able to post bail due to financial constraints. If this happens, a local bondsman can be hired to act as a surety. He will be held liable by the court to pay the entire bail amount should the accused fail to appear in court for his trial. The bondsman typically charges a non-refundable fee which is 10% of the bail amount.

The commercial bail bond industry has been outlawed in Kentucky. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). A warrant is required to arrest a fugitive who has fled to Kentucky if the bonds agent is from out of state. Ky. Rev. Stat. § 440.270.
