Bail and Bondsman

Bail is the process that allows an inmate to be released from jail while his trial is still pending with the understanding that he will be present at all his scheduled court appearances. For some cases, a monetary value is assigned to the bond which is an added insurance that will guarantee a defendant’s appearance during his trial. If he misses one, the money pledged to the court will be forfeit. In Crittenden County, bonds can be paid at the Circuit Court Clerk’s office located at 107 S Main St, Marion, Ky 42064. Business hours are Monday to Friday from 8 am to 3:30pm.

If posting bail is not possible because the defendant lacks funds, a bondsman can be hired for a fee (10% of the bail amount). Upon hiring, the bondsman will sign the bond, agreeing to be held liable by the court if the defendant does not perform the conditions of his bail.

Kentucky, commercial bail bonding (the use of a bondsman) is illegal. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute).  If a bondsman wishes to arrest a fugitive currently hiding out in Kentucky, he will need to get a warrant. Ky. Rev. Stat. § 440.270
