Bail and Bondsman

Bail is the court’s written permission that allows a defendant to secure his temporary release from jail while his trial is still pending. To post bail, some defendants need only sign the bond stating their promise to attend all court appearances that are required of him/her. For some crimes, the bond will also require the payment of money or property along with the promise of the defendant’s presence in court. Failure to keep this promise will mean the property or money will be forfeited.

A bondsman charges 10% of the bail amount in exchange for his promise to the court to be the one who will pay the entire bail amount if the defendant misses a court appearance. The fee charged is non-refundable.

Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). A bondsman operating from another state may only arrest a fugitive who has run to Kentucky if he gets a warrant. Ky. Rev. Stat. § 440.270.
