Bail and Bondsman
Bail is the granting of the court’s consent, allowing an individual charged with a crime to stay out of jail while his trial has yet to start. Once it starts, the court will require the individual to appear at all of his court dates. Depending on the individual and the gravity of the charges, the court may also require the individual to pay money or put down property as collateral. If he does not appear as promised, the money or property will be forfeited to the court.
An accused individual who cannot pay the bail amount may need the services of a bondsman. A bondsman is a person who acts as a surety. He will sign the accused’s bond, promising to pay the entire bail amount should the accused miss any of his court appearances. To hire a bondsman, you will need to pay him a non-refundable fee that is usually set at 10% of the bail amount.
Commercial bail bonding is illegal in Kentucky. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). If a bondsman from out of state wants to arrest a fugitive currently hiding out in Kentucky, he must obtain a warrant first. Ky. Rev. Stat. § 440.270.
