Bail and Bondsman
The court can grant a temporary get-out-of-jail-free card to an accused individual while he waits for his court date. This process is called a bond or bail. For some bonds, such as the surety bond, no payment is made. But the defendant is held liable by the court to pay the entire bail amount if he misses a court appearance. For individuals who are unable to post bail because of monetary concerns, a bondsman can act as a surety for the defendant. This means that upon hiring, the bondsman can sign the bond that will declare him responsible for paying the entire bail amount if the defendant does not comply with the conditions of his release. To hire a bondsman, you will need to pay him a non-refundable fee that is usually somewhere between 8-10% of the bail amount.
It is illegal to practice commercial bail bonding in Kentucky. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). Bond agents coming from out of state are not allowed to arrest a fugitive hiding out in Kentucky without a warrant. Ky. Rev. Stat. § 440.270.
