Federal law states that all sex offenders must have their information entered into the national and state sex offender databases. A sex offender is an individual who has been convicted of a sexually oriented crime such as rape, child pornography, and prostitution. Residents of Fayette County can use this site to locate any sex offenders residing in their neighborhood. It is important to note that the state government cannot guarantee the accuracy of the information listed in the database as some sex offenders do not update their registration. Bail and Bondsman
An accused person is allowed to secure his release while awaiting trial through the process called bail. As long as the accused can guarantee his presence at all of his mandated court appearances, the court will allow him to stay out of jail. In some cases, the court may place additional conditions for his release such as the pledging of money or property. If he does not appear before the court at his trial, the money or property is forfeited.
A bondsman is used when an accused is unable to post bail due to financial reasons. The bondsman can pay the entire bail amount on behalf of the accused if he does not appear before the court as promised. In return for his service, the bondsman will charge a non-refundable fee that is usually set at 10% of the entire bail amount.
In the state of Kentucky, it is prohibited to run a commercial bail bond company. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). A bondsman from a different state must obtain a warrant before he can arrest a fugitive who has run away to Kentucky. Ky. Rev. Stat. § 440.270.
