Bail and Bondsman
To obtain temporary release from custody or jail while you wait for your trial to start, you will be asked by the court to guarantee your presence during your scheduled court appearances. Part of the guarantee is the pledging of money or property. This is called bail. If you miss one of your court dates, then you lose the money or property you put down as collateral and you will be called a fugitive.
If the bail amount set by the court is too high, you can hire a bondsman to post the bond for you. He will be the one who will be responsible for paying what is due to the court if you do not show up for your trial. In return for this service, a bondsman will require the payment of a non-refundable fee. This is usually set at 10% of the bail amount.
Practicing commercial bail bonding is not allowed in the state of Kentucky. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). To apprehend a fugitive who has run away to Kentucky, a bondsman from another state must obtain a warrant. Ky. Rev. Stat. § 440.270.
