Bail and Bondsman
Bail is when the court allows an inmate to stay out of jail for the remainder of the time before his trial begins as long as he promises to appear before the court at his trial. In some cases, bail is also the monetary value or property that is assigned by the court as another form of guarantee that will ensure the defendant’s appearance at his trial. The money/property pledged to the court will be forfeited if the defendant violates the condition of his bail.
If you find yourself unable to post bail because you don’t have enough money, a bondsman can post the bail for you in exchange for a non-refundable fee that is normally set at 8-10% of the bail amount. Commercial bail bonding is illegal in Kentucky. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). Fugitives who have fled to Kentucky cannot be arrested by a bondsman without a warrant. Ky. Rev. Stat. § 440.270.
