A person charged with a crime in Shelby County can be granted temporary release from custody while awaiting trial through the process of bail. Bail is the money or property set by the court that must be paid to them by the defendant in exchange for his/her release. This helps ensure the presence of the defendant in court when the trial starts. Bail is forfeited when the defendant violates the conditions of his/her release.
Posting bail can be done through a third party – a bondsman – if the defendant is unable to come up with the money on his own. A bondsman typically charges 10% of the bail amount as his fee and it is non-refundable.
