Bail and Bondsman

A charged individual in Rutherford County is allowed to stay out of jail while his/her trial is pending as long as he can post bail. Bail is the money or property that the court requires in exchange for allowing a defendant’s freedom. This ensures that the defendant will appear before the court once the trial starts. If he/she doesn’t, the money or property is forfeited.

If the defendant cannot post bail because he lacks funds, the court will allow him to hire a bondsman to do it on his behalf. In this case, the court will recognize the bondsman as the person liable to pay the entire bail amount should the defendant fail to appear. To hire a bondsman, the defendant must pay him 10% of the bond amount. This fee is non-refundable.
