Bail and Bondsman

An accused individual may be released from jail while awaiting trial through bail. Bail is the collateral required by the court before it will allow a defendant to leave custody. The collateral can be in the form of money or property and will be used to guarantee that the defendant returns for his trial. Failure to appear in court will mean forfeiting the money and becoming a fugitive.

A bail bondsman is a person who can be paid to post bail on behalf of a defendant. He typically charges 10% of the bail as his fee which cannot be refunded. A bondsman is usually hired by defendants who cannot afford to pay the entire bail amount set by the court.
