Bail and Bondsman

If you ever get charged with a crime in Oregon, you may be allowed to post only 10% of the total bail amount. This portion is called security and is used by the court to help guarantee your return to court when the trial starts.

If the judge is opposed to letting you get out of jail on personal recognizance or conditional release, he may set a bail amount for you to pay. Because the amount will be determined by the crime, the criminal record of the accused, and his/her history of violence, bail amounts do vary. For example, if you were charged for drug possession, you may get a bail of $10,000. However, should you be charged with a sex crime, you may get bail set at $75,000.

In Oregon, there are no bail bond agencies. This is because it has outlawed commercial bail bonding. In fact, it is one of just four states that have done so (Kentucky, Illinois, and Wisconsin). If a defendant skips bail, it will be the state’s justice department who will be responsible for apprehending him, not a bounty hunter.
