Bail and Bondsman

If an individual is charged with a criminal offense, the court may allow temporary release from custody of the accused while awaiting trial. This is called bail. The release is set with a condition – a pledge of money that will guarantee the appearance of the defendant in court. If he or she fails to appear, the money will be forfeit.

For individuals who are unable to post bail, a bondsman can be hired. A bondsman is an individual who will act as a surety, securing the release of the accused and allowing himself to be held liable by the court to pay the bond should the defendant fail to meet the conditions of his bail. In return for such a service, the bondsman will require the payment of a non-refundable fee, 10% of the bail amount, as well as a collateral on the rest of the bail amount.
