Bail and Bail Bond Agent

Bail is the money or bond lodged with the court in exchange for the temporary release of a defendant waiting for trial. The court will utilize this as a form of collateral to secure the appearance of the defendant at his trial. Bail is refunded at the end of the trial minus a 3% administrative fee. The defendant forfeits the bail if he does not fulfill his court obligations. A warrant for his arrest is also issued. If the bail is not paid, the defendant stays in jail until he is released or the case is dismissed.

Bail must be paid in the exact amount. This is because the New York courts will not give you any change. You can, however, pay bail using more than one form of money. The acceptable forms of payment are as follows:

  • US Cash
  • Cashier’s checks (amount should not be more than the bail)
  • Credit card (must pay an 8% processing fee)
  • Debit Card
  • Money order (from Western Union or bank, each order should not be more than $1000)
Bond agents provide their services to defendants who are unable to post bail due to financial difficulties. They charge a non-refundable bond fee for their services. The New York State Insurance Department regulates the bail bond industry within the state. As such, the fee can easily be calculated using the tiered system in place:

For a bond of $200 or less, the fee is $10.
For a bond of $3000 or less, the fee is 10% of the bail amount.
For a bond that is $3001 to $10000, the fee is 10% of the first $3000 and 8% for the rest of the amount.
For a bond that is higher than $10000, the fee is 10% of the first $3000, 8% for the amount between $3000 and $10000, and 6% for the rest.
    Here’s an example:
    A $15000 bond has a bond fee of $1160. That amount is a result of using this formula: (10% x $3000) + (8% x $7000) + (6% x $5000).
