Bail and Bail Bond Agent:

The court may allow a pretrial inmate to be released temporarily from custody after a payment in cash or bond has been made. This payment, called bail, will be used to secure the defendant’s appearance in court at his trial. The payment will be refunded, minus a 3% administrative fee, if the defendant was able to appear at all of his scheduled court dates. It will be forfeited if he misses an appearance. A warrant will also be issued for his arrest. If bail is not posted, then the defendant will have to remain in jail for the entire duration of the trial or until he is released.
Bail can be paid using different kinds of money in one transaction. This is because the exact amount is required by the courts in New York. Change will not be given. The modes of payment accepted are as follows:

  • US Cash
  • Cashier’s Check (the amount should not be bigger than the bail amount)
  • Debit Card
  • Credit Card (requires payment of an 8% processing fee)
  • Money Order from a bank or Western Union (must not be more than $1000 per order; multiple orders accepted)
Bond agents and their fees are regulated by the New York State Insurance Department. To calculate your bond fee, you can use the tiered system below:
For a $200 bond or less, the fee is $10.
For a $3000 bond or less, the fee is 10% of the bail.
For a bond of $3001 to $10000, the fee is 10% of $3000 and 8% of the remaining amount.
For a bond of more than $10000, the fee is 10% for the first $3000, 8% for the amount between $3000 and $10000, and 6% for the amount left.
    For example, the bond fee for a $15000 bond is calculated using this formula: (10% x $3000) + (8% x $7000) + (6% x $5000) = $1160.
