Bail and Bail Bond Agents

A defendant awaiting trial can get released from jail as long as bail has been posted. Bail is the money or bond pledge to the court in order to secure the defendant’s compliance with all of his court obligations. The court will give a refund of the bail minus a 3% administrative fee at the end of the trial. Bail will be forfeited if the defendant misses even just one of his scheduled court appearances. If bail has not been posted, the defendant will remain in custody until the case is dismissed or he is released.

The exact payment must be made when posting bail because the New York courts will not give any change. If needed, payments can be made using more than one type of money. The forms of payment accepted by the courts are as follows:

  • US Cash
  • Cashier’s Check (cannot be more than the bail)
  • Money orders from Western Union or a bank; each order must not be higher than $1000
  • Credit Card; will require payment of an 8% processing fee
  • Debit Card

In New York, a defendant can hire a bond agent to post bail on his behalf. Unlike bail, the bond fee cannot be refunded. The New York State Insurance Department monitors bond agents and their fees. To find out how much your bond fee is, you can use the tiered system below.

A bond of $200 or less will have a fee of $10.
A bond of $3000 or less will have a fee that is 10% of the bail amount.
A bond of $3001 to $10000 will have a fee that is 10% for the first $3000 and 8% for the rest of the bail amount.
A bond greater than $10000 will have a fee that is 10% for the first $3000, 8% for the amount between $3000 and $10000, and 6% for the rest of the bail amount.
    For example:
    If you have a $15000 bond, the bond fee will be the result of (10% x $3000) + (8% x $7000) + (6% x $5000). Using that formula, you will get $1160.
