The law mandates that sex offenders must register their information with the local law enforcement so that it may be included in the state and national sex offender registries. Bail and Bondsman

Bail is the written consent of the court allowing an individual charged with a crime to stay out of jail for the remainder of the time he awaits trial. This is given with the understanding that the accused must be present at all of his scheduled court appearances. A violation of this promise will label the defendant a “fugitive.” For certain offenses, the court may assign a monetary value to their written consent. Along with the promise, the defendant must lodge the amount assigned by the court. The money or property will be lost if the defendant fails to keep his promise.

A bondsman is an agent who acts as a surety. This means that he will be the one to owe the money to the court if a defendant skips bail. Most people who hire a bondsman are those who have no way to come up with the money required by the court to secure the release of a defendant. The bondsman’s fee is usually set at 10% of the bail amount. It is non-refundable.

The state of Kentucky has outlawed the commercial bail bonding industry. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). Fugitives who have fled from Kentucky cannot be arrested by bonds agents from out of state without a warrant. Ky. Rev. Stat. § 440.270.
