Bail and Bondsman

A pretrial inmate can stay out of jail while his trial is pending as long as bail has been posted. Bail is the money lodged with the court as a form of insurance. If the defendant obeys all the conditions of his release, the money will be returned minus any court fees. If he violates any of the conditions, the money is forfeited.

If a defendant cannot pay bail because of a financial lack, he can hire a bondsman to assist him. A bondsman charges 12% of the bail amount as his fee which is non-refundable. Once hired, the bondsman will sign a bond with the court to secure the release of the defendant. If the defendant violates the conditions of his release, it will be the bondsman’s responsibility to pay the amount stated in the bond.
