Bail and Bondsman

Bail allows a defendant to stay out of jail while awaiting trial. Posting bail means to give money to the court that will be held in its keeping for the entire duration of the trial. This is to ensure that the defendant keeps his promise to return to court once the trial is underway. Failure to appear means the money will be forfeited.

If the defendant cannot afford to pay the bail, he can still get released from jail with the help of a bondsman. The bondsman secures his release by signing a bond with the court. This will be paid by the bondsman if the defendant misses a court appearance. The fee of a bondsman is 12% of the bail amount. This cannot be refunded.
