Bail and Bondsman
A person arrested in West Virginia can get released from custody/jail as long as he is able to post bail. Bail is the bond set by the court to be paid (in the form of money or property) by the defendant or a surety (someone, aside from the defendant, who secures the bail). This bond is then used to ensure the defendant’s compliance with all the terms and conditions of the court order which includes showing up at all scheduled court appearances. If the defendant violates any of the terms or conditions, the bond is forfeited.
A bondsman is a surety, a person who is in the business of funding a defendant’s bail should he/she be unable to afford it. The bondsman’s fee is typically 10% of the bail amount. Unlike bail paid to the court, this fee cannot be refunded no matter what.
