Bail and Bondsman
The money lodged with the court in exchange for a defendant’s temporary release from jail while the trial is still pending is known as bail. Bail serves to provide the court with a certain degree of assurance that the defendant will appear for his trial. If the defendant misses a scheduled court appearance, he forfeits the money.
If a defendant has financial difficulties and cannot afford the bail set by the court, he can pay 10% of the bail amount to a bondsman who can then secure his release on his behalf. The bondsman’s fee, unlike the court’s bail, cannot be refunded.
