Bail and Bondsman

A pretrial inmate’s “get-out-of-jail-free” card is actually bail. This is the money required by the court to ensure the inmate’s return to court once the trial begins. If he or she does not show up as promised, the inmate forfeits the money and is labeled a fugitive.

If the inmate cannot afford the bail set by the court, a bondsman can be hired to secure his release. For a fee, a bondsman can act as a surety, signing a bond with the court and becoming liable for payment of the entire bail amount should the inmate fail to appear. The fee of a bondsman is usually 10% of the bail amount. This cannot be refunded.
