Bail and Bondsman

In order for a defendant to remain free while awaiting trial, he must pledge money to the court. This money, called bail, will be used by the court to secure the defendant’s compliance with all of the court’s orders. If he violates the conditions of his release, the defendant forfeits the bail.

A bondsman can post bail on behalf of a defendant in exchange for a non-refundable fee. This is one way for a defendant to be able to remain free while awaiting trial even if he cannot afford the entire bail. A bondsman typically charges 10% of the bail amount for his services.
