Bail and Bondsman
A defendant can lodge money with the court to remain out of custody while awaiting trial. This is known as posting bail. The payment will be used by the court to secure the defendant’s return for his trial. When the trial starts and the defendant fails to appear, then he loses the money and is labeled a fugitive.
If the defendant is unable to post bail for financial reasons, a bondsman can be hired to act as a surety. For 10% of the bond amount, he will sign the bond with the court and secure the defendant’s temporary release. Unlike bail, this fee is non-refundable.
