The Smyth County District Court Clerk is responsible for recording instruments or other documents related to the District Civil, Criminal and Traffic cases. The responsibilities provided by the District Court Clerk include, maintaining a record of liens on real estate, judgments, maintains the court docket, collects filing fees in civil cases, collects court costs, fines and restitution in criminal cases, and processes all kinds of miscellaneous documents for civil and criminal cases transmitted to the court.

Services and Responsibilities:
The Clerk of the Circuit Court of Smyth County is the custodian of records for the Circuit Courts, responsible for providing administrative support for all courtroom proceedings i.e. creates and maintains all court files and records, maintains the court’s docket, preserves evidence, trains and summonses jurors, prepares court orders for all criminal cases, issues arrest and other legal documents, collects court costs, fines, and restitution. Besides, the Clerk of the Circuit Court acts as an initial probate judge taking action on validity of wills and identifies heirs. Moreover, the Circuit Court Clerk serves as a county’s register of deeds, responsible for recording deeds, deeds of trust, surveys, powers of attorney, judgments, and other documents related to land. Furthermore, processing concealed handgun permits, marriage licenses, notary appointments, ministers’ bonds, trade names for businesses, oaths for various local officials, and financing statements are also handled by the Circuit Court Clerk.
