Bail and Bondsman
Once a person is charged with a criminal offense, he may be temporarily released from custody or jail until the trial begins. This is what the court means by bail. Before he can be granted bail, an accused must guarantee that his presence in court any time it is required. The state of Kentucky prohibits the practice of commercial bail bonding. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). A bonds agent from a different state needs to get a warrant before he can arrest a fugitive in Kentucky. Ky. Rev. Stat. § 440.270.
