Bail and Bondsman

Bail is the process of temporarily releasing an inmate from jail while he/she is waiting for his court date. The release of an inmate is usually made with conditions such as pledging money to the court as part of his promise to show up for all of his scheduled appearances. If the defendant fails to perform the conditions of his release, the money is forfeited. Depending on the type of bail, the defendant may end up owing money to the court as well.

For inmates who are unable to post bail because they lack money, a bondsman can be hired to act as a surety. The bondsman will sign the bond, guaranteeing to the court that full payment of the bail amount will be made by him if the defendant violates the conditions of his release. To hire a bondsman, you will need to pay him a non-refundable fee that is usually equal to 8-10% of the bail amount.

Practicing commercial bail bonding in Kentucky is illegal. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). Fugitives who are currently in Kentucky cannot be arrested by out-of-state bond agents without a warrant. Ky. Rev.
