Bail and Bondsman

There are three ways that an accused individual can be released from jail in Oregon. He can be released on personal recognizance or conditional release. If the judge decides that these two options are not sufficient, he can assign a bail amount in exchange for the defendant’s release.

The amount of bail set by a judge will depend on the individual’s crime, criminal history, and connections in the community. This means that bail amounts may vary. A person accused of drug possession may have his bail set at $10,000 while another individual charged with a sex crime may have his bail set at $75,000.

In some cases, the court will allow the accused to post 10% of the bail amount, called security, to the court. This pledge will be used to secure the defendant’s appearance in court.

If the defendant fails to appear, he will be labeled a fugitive. However, a bounty hunter will not be involved in catching him. Commercial bail bonding is illegal in Oregon, one of only four states that have banned this practice. It will be the justice department’s responsibility to act as a bail bond agency and apprehend the fugitive.
