Bail and Bail Bondsman:

Bail is required by the court before a defendant can be released while awaiting trial. Bail is a payment of money or bond which the court will use to secure the defendant’s attendance at all of his court dates. If he complies with all of the conditions of his release, the defendant will get the bail back minus a 3% administrative fee after the trial. Missing one of his court dates will result in the bail getting forfeited and the issuance of a warrant for the defendant’s arrest. For defendants who are unable to post bail, they will have to remain in jail until the case is done or dismissed, or he is released.
Bail can be paid using different forms of money, even in one transaction. This is because the courts in New York will only accept the exact amount. Change will not be provided. The following modes of payment are acceptable:

  • US Cash
  • Credit Card (8% processing fee) or Debit Card
  • Money Order from a bank or Western Union (must be not higher than $1000 per order, multiple orders accepted)
  • Cashier’s Check (no more than the bail amount)

The New York State Insurance Department regulates bond agents and have placed their fees in a tiered system for easy calculation. Take note that bond fees cannot be refunded.
For a bond of $200 or less, the fee is $10.
For a bond of $3000 or less, the fee is 10% of the bail.
For a bond of $3001-$10000, the fee is 10% for $3000 of the bond and 8% for the remaining amount.
For a bond greater than $10000, the fee is 10% for $3000 of the bond, 8% for the amount that falls between $3000 and $10000, and 6% for the remaining.
For example, to get the bond fee for a $15000-bond, you will need to get 10% of $3000, 8% of $7000, and 6% of $5000. So the bond fee would be $1160.
