Bail and Bail Bondsman

If a person is charged with a crime in Cattaraugus County, he or she can be temporarily released from jail as long as bail has been posted. Bail is an amount of money or bond required by the court in order to ensure that the defendant will appear at all court obligations. The bail will be returned to the defendant, minus a 3% administrative fee, once the trial is over as long as all court obligations have been met. If the defendant fails to appear, the bail will be kept by the court and a warrant on the defendant will be issued. If a defendant is unable to post bail for any reason, he or she will be held in jail until the bail is paid, the case has been dismissed, or the defendant is released.

In New York, the exact amount of bail must be paid because the court will not provide any change. You can, however, combine multiple kinds of payment in one transaction. The court will accept the following forms of payment for bail: US cash, Cashier’s Check (cannot exceed bail amount), Bank money order (each order should not be greater than $1,000), Western Union (each order should not be greater than $1,000), and credit/debit card (8% processing fee).

If a defendant cannot afford bail, he can use the services of a bond agent in exchange for a fee. The bond fee is non-refundable. The New York State Insurance Department regulates bond agents and their fees. Below are the calculated fees per bond amount:

  • a bond of $200 or less has a fee of $10.
  • a bond of $3000 or less has a fee equal to 10% of the bond.
  • a bond amount that falls between $3,001 and $10,000 has a fee equal to 10% of the bond for the first $3000 and 8% for the remaining amount between $3,000 and $10,000.
  • a bond that is more than $10,000 has a fee equal to 10% of the bond for the first $3000 and 8% for the amount between $3,000 and $10,000, and 6% for the remaining amount greater than 10,000.

    For example, a $15,000 bond has a fee equal to $1,160. The calculation is $3,000*10% + $7,000*8% + $5,000*6%.
