Bail and Bondsman
A defendant can remain free while awaiting trial if he has posted bail. Bail is the money or property that will be handed over to court as collateral to secure the defendant’s compliance with all of the court’s orders. The court will return the money or property to the defendant at the end of the trial, minus some court fees. The bail is forfeited if the defendant fails to appear in court.
A bail bondsman is hired if a defendant cannot post bail on his own. For a fee, the bail bondsman will sign a bond with the court in exchange for the release of a defendant. The fee is usually 10% of the bail and cannot be refunded.
