Bail and Bondsman

A defendant is allowed to stay out of jail while awaiting trial if he or she is able to post bail. Bail is the amount of money set by the court that will be used to guarantee the defendant’s return to court once the trial starts. Failure to appear means forfeiting the money.

Some defendants are unable to post bail due to financial constraints. If this is the case, these defendants can still secure their temporary release from jail with the help of a bondsman. A bondsman is in the business of signing bonds with the court that will guarantee the defendant’s appearance in court. If the defendant skips bail, the bondsman is liable to pay the entire bond amount to the court. A bondsman’s fee is 12% of the bail amount. This is not refundable.
