Bail and Bondsman

Bail is the amount of money you put down as a form of collateral in exchange for the temporary release of a defendant awaiting trial. The money is used to ensure that the defendant will appear in court for the duration of the trial. Failure to do so will result in forfeiting the bail.

Defendants who cannot post bail due to a lack of funds can pay a bondsman instead to help them get temporarily released from jail. The payment is usually 12% of the bond amount. It cannot be refunded. A bondsman can secure the release of a defendant by signing a bond with the court. This bond will be used as a form of insurance as well, similar to the bail.
