Bail and Bondsman

A defendant can post bail – money – to stay out from jail while awaiting trial. The money is used to ensure that the defendant will comply with the court’s requirements. If the defendant misses one of his court dates, he loses the money.

A bondsman can assist  a defendant in getting out of jail even if he cannot post bail. The bondsman charges 12% of the bail amount as his fee and this cannot be refunded. Once hired, he will sign a bond with the court that will allow the defendant to be released. If the defendant fails to show up in court, the bondsman needs to pay the entire bond amount to the court.
