Bail and Bondsman
To secure the release of a pretrial inmate from jail, money must be put down as a form of collateral that will help guarantee the inmate’s return to court once the trial starts. This process is called bail. If the conditions of the bail are not met by the inmate, the money is forfeited.
A defendant who cannot come up with enough money to post bail can still get released from custody with the help of a bondsman. A bondsman usually charges 12% of the bail amount as his fee which cannot be refunded. Once hired, the bondsman signs an agreement with the court with regard to the inmate’s release. He will pay the entire bond amount to the court if the defendant fails to appear as promised.
